The Wet bescherming bedrijfsgeheimen [Trade Secrets Act] has not been around for very long. The law came into effect in 2018. This law provides business owners with protection against unlawful acquisition, use and disclosure of business information.

For you as a business owner, it is important to properly detail in a contract how your employees should deal with trade secrets during and at the end of their employment. For example, you can draw up a confidentiality clause or an NDA with a penalty clause. It is recommended that existing contracts are reviewed and amended where necessary.

Among other things, we pay specific attention to regulations concerning trade secrets and non-competition clauses in the employee’s employment contract. This will ensure you know that your business secrets are in safe hands, even when an employee is no longer employed by you.
